Uluslararası hukuk bölünüyor mu? Uluslararası hukukun genişlemesi ve farklılaşmasından kaynaklanan zorluklar

Abstract

Yirminci yüzyılın ikinci yarısından itibaren uluslararası alanda yaşanan gelişmeler, uluslararası hukukun kapsamının genişlemesine ve etki sahasını artırmasına neden olmuştur. Bu genişleme neticesinde devletler arasında ikili ve çoklu andlaşmalar temelinde ayrıntılı uluslararası hukuk kuralları oluşturulmuştur. Hatta öyle ki; coğrafi ve konu bazında alt uluslararası hukuk sistemleri doğmuştur. Bu süreç aynı zamanda, uluslararası hukuk kuraları arasında bölünme ve çatışma endişesini de beraberinde getirmiştir. 2006 yılında Birleşmiş Milletler altında faaliyet gösteren Uluslararası Hukuk Komisyonu (UHK) uluslararası hukuk kuralları arasındaki bölünme ve çatışmanın nasıl ortadan kaldırılacağına ilişkin bir rapor yayımlamıştır. UHK’ya göre; uluslararası hukuk genişlemekte ve fonksiyonel olarak farklılaşmaktadır. Ancak, genişleme ve farklılaşmadan doğan bölünme ve çatışma endişesi, Andlaşmalar Hukukuna İlişkin Viyana Konvansiyonu temelinde, ulusal hukuklarda klasik olarak kullanılan özel kural-genel kural, önceki kural-sonraki kural, uluslararası hukuk kuralları arasında hiyerarşi ve sistematik entegrasyon başlıkları altında ifade edilen teknikler etrafında çözülebilecek niteliktedir. UHK’nın; uluslararası hukukun genişlemesi ve fonksiyonel olarak farklılaşması konusundaki tespiti doğru olmakla birlikte, kurallar arasındaki çatışmaların kaldırılması için önerilen teknikler ile bunların uluslararası hukukun bölünmüşlüğü endişesini ne ölçüde gidereceği tartışmalıdır

Does the International Law Fragment? Difficulties Arising From the Diversification and Expansion of International Law

Abstract

From the second half of the twentieth century, developments in the international arena have allowed international law to expand its scope and increase its effects. As a result of this expansion, detailed rules of international law are formed mainly on the basis of bilateral and multiple treaties between the states. Furthermore, sub-systems of international law have been created on geographical and subject bases. This process, at the same time, has brought concerns about the fragmentation and conflict of international rules. In 2006, International Law Commission (ILC), operating under the United Nations, published a report concerning how to remove the conflict and fragmentation between international rules. According to ILC, international law expands and functionally differentiates. However, on the basis of Vienna Convention on the Law of Treaties, concerns of fragmentation and conflict of international rules would be solved by using lex specials – lex generalis, lex prior-lex posterior, hierarchy in international law and the systematic integration techniques, which are classically used in national laws. Although the identification of the problem by ILC is correct, proposed techniques concerning the removal of conflict between international rules and to what extend these techniques ease concerns about the fragmentation of international rules are debatable
