Abstract

Kölelik kurumuna ilişkin olarak Roma hukuku tarafından getirilen düzenlemelerin, yapay zekâya sahip robotların hukukî statüsünün ve yapay zekâ kullanımından doğan hukukî sorumluluğun belirlenmesinde model olarak alınması ise, bu robotların kişi olarak kabul edilmelerinin özellikle hukukî sorumluluğun belirlenmesi bağlamında yaratabileceği olumsuz sonuçların ortadan kaldırılmasına imkân verecektir.

Taking the Concept of Peculium as a Model for Determining the Legal Status of Robots with Artificial Intelligence

Abstract

Modern technology calls for a legal framework for the legal integration
of highly developed robots (autonomous robots-artificially intelligent robots)
into our society. Because as a result of technological developments,
artificially intelligent robots are used daily in many industries and by
individuals more and more. Since there is no special legal status provided for
artificially intelligent robots, it has become a necessity to regulate legal
systems according to developments in artificial intelligence technology. How
the legal status of this robots should be regulated is one of the most
discussed topics in scientific studies on the subject. One of the views put
forward in the doctrine on this subject is that artificially intelligent robots are
accepted as electronic persons. However, granting legal personhood
(electronic personhood) to robots for determining rights and responsibilities
of these entities could cause some problems. Get the advantage of the
institution of slavery while determining the legal status of artificially
intelligent robots is another view put forward on this issue. In this respect,
legal status of Roman slaves and specially the concept of peculium could be
an alternative legal remedy.
