İklim Değişikliği Önlemleri Bağlamında Dünya Ticaret Örgütü Kural ve Uygulamalarına Genel Bir Bakış

Abstract

İklim değişikliği nedeniyle artan sıcaklıklar ve etkileri hem azaltım hem de uyum önlemlerine aciliyet kazandırmıştır. Devletlerin Paris Anlaşması sonrası karbon nötr olma hedefleri ve bu hedefler için alınan önlemlerin uluslararası ticaret üzerindeki etkileri dikkat çekmektedir. 1947 tarihli Gümrük Tarifeleri ve Ticaret Genel Anlaşması’nın (GATT) devamı olarak 1995’te kurulan Dünya Ticaret Örgütü (DTÖ) bağlayıcı temel kuralları ile ticaret politika ve uygulamalarına yön vermektedir. Bu bağlamda GATT/DTÖ sisteminin iklim değişikliği sorunu ile bağı, ticareti etkileyen iklim önlemlerinin DTÖ içindeki potansiyel varlığı ve etkileri sorgulanmaktadır. Bu çalışmada iklim değişikliği azaltım ve uyum önlemleri bağlamında DTÖ kural ve uygulamalarının incelenmesi, iklim önlemlerinin, nedenleriyle birlikte yer bulabileceği/ bulamadığı yasal çerçevenin betimleyici yöntemle ortaya konulması amaçlanmıştır. Sonuç olarak iklim değişikliği ile mücadele edebilmek için DTÖ’de yenilikçi kural ve uygulamalara yer açılması, çok taraflı iş birliğinin derinleştirilmesi, ülkeler arasındaki hem ticaret hem de iklim asimetrilerinin ortadan kaldırılması gerekmektedir. Bu konu iklim değişikliği sorununun karmaşık ve zorlayıcı boyutlarından birisidir.

An Overview of the World Trade Organisation Rules and Practices in the Context of Climate Change Measures

Abstract

Increasing temperatures and their effects due to climate change have given urgency to both mitigation and adaptation measures. The states' targets to become carbon neutral after the Paris Agreement and the effects of the measures taken for these targets on international trade draw attention. The World Trade Organisation (WTO), which was established in 1995 as the continuation of the 1947 General Agreement on Tariffs and Trade (GATT), directs the trade policies and practices. In this study, it is aimed to examine the WTO rules and practices in the context of climate change mitigation and adaptation measures, and to reveal the legal framework in which climate measures can/cannot find a place together with their reasons, by descriptive method. As a result, in order to combat climate change, it is necessary to make room for innovative rules and practices in the WTO, to deepen multilateral cooperation, and to eliminate both trade and climate asymmetries between countries. This issue is one of the complex and challenging dimensions of the climate change problem.
