The homeworker employment contract as a special type of the employment contract is a new type of contract which is regulated in Turkish Code of Obligations No. 6098. It is a type of contract concluded between the employee and the employer. Under this contract, the homeworker undertakes to work for the employer in the place determined by him. The homeworker employment contract may be concluded for a limited or indefinite duration. Besides, working of the homeworker is regulated on a continuous or broken basis. Under this contract, the homeworker undertakes to work in return for a salary. The homeworker employment contract differs from the employment contract in Labor Law No. 4857 because of its own specific provisions. Provisions of the homeworker employment contract have special nature. For this reason, the general provisions of general employment contracts are applicable by way of supplement to homeworker employment contract. . The Home Service Agreement is an atypical contract. In practice, we see that the working side of this contract is mostly women. Because this contract is preferred by women as it includes working remotely. Therefore, existing legal regulations should be developed in order to keep up with developing technologies.
