Ulus ve Ulusçuluk Kavramlarına Genel Bir Bakış

Concepts related to nation and nationalism began to be debated in the 19th century and have led to many different views in the literature. On the other side of these concepts lie current social problems and debates concerning identity. To better understand problems related to identity, it is necessary to comprehend the literature on concepts of nation and nationality. This is because all rules and processes that regulate society, particularly law, cannot be considered independently of the concept of identity. Although the concept of the nation is accepted as belonging to the modern state, its roots extend beyond it. When this situation is neglected, contemporary identity problems and the legal and sociological issues arising from them remain unsolved. Therefore, the primary aim of this study is to provide a general overview of the literature on these concepts and an introduction to further reading for researchers working in both legal practice and legal theory, thereby emphasising the importance of identity and the concept of nation in relation to identity in legal studies. In this context, existing views in the literature have been classified, and an attempt has been made to reveal the connection between ethnicity and nation. Based on the connection between ethnicity, a sociological concept, and nation, a political concept, it has been attempted to demonstrate that these are not separate phenomena but rather interrelated and interconnected sociological phenomena. Furthermore, the importance of the ethno-symbolist view for identity studies has been explained in comparison to other views in the literature that have been pushed to extremes.

Ulus ve ulusçuluğa dair kavramlar, 19. Yüzyıldan itibaren tartışılmaya başlanmış ve literatürde pek çok farklı görüşe yol açmıştır. Bu kavramların öte tarafında ise kimlik ve kimliğe dair güncel toplumsal problemler ve tartışmalar yer almaktadır. Kimlik ile ilgili problemlerin daha iyi anlaşılabilmesi için ulus ve ulus ile ilgili kavramlar ile ilgili literatürün kavranması bir gerekliliktir. Çünkü hukuk başta olmak üzere toplumu düzenleyen bütün kural ve işlemler kimlik mevhumundan bağımsız düşünülemez. Ulus kavramı her ne kadar modern devlete ait bir kavram olarak kabul edilse dahi kökleri modern devletin öncesine uzanmaktadır. Bu durum gözden kaçırıldığında günümüz kimlik problemleri ve bundan doğan hukuksal ve sosyolojik sorunlar da çözümsüz kalmaktadır. O yüzden hem hukuk pratiği üzerine hem de hukuk teorisi üzerine çalışan araştırmacılar için çalışmamızın birincil amacı bu kavramlara ait literatürün genel bir derlemesi ve ileri okumalara yönelik bir girizgâh oluşturmak ve böylece hukuk çalışmaları için kimlik ve kimlikle ilgili olarak ulus kavramının önemini vurgulamaktır. Bu bağlamda literatürde mevcut olan görüşler tasniflenmiş ve etnisite ile ulus arasındaki bağlantı ortaya çıkarılmaya çalışılmıştır. Sosyolojik bir kavram olan etnisite ile siyasal olan ulus arasındaki bağlantıdan hareketle bunların birbirlerinden ayrı ele alınması gereken değil fakat birbirleri ile geçişken ve ilintili birer sosyolojik olgu oldukları ortaya konmaya çalışılmış ve etno-sembolist görüşün kimlik çalışmaları için literatürde uçlara savrulan diğer görüşlere nazaran önemi açıklanmaya çalışılmıştır.
