AN EXAMINATION OF CHINA'S HUMAN RIGHTS VIOLATIONS AGAINST UYGHUR AND OTHER TURKIC MUSLIMS IN THE CONTEXT OF GENOCİDE UNDER INTERNATIONAL LAW

Öz

In this study, China's human rights violations against Uyghurs and other Turkic Muslims are analyzed in the context of genocide within the scope of international law. The study is examined under four headings. First, the Xinjiang Uyghur Autonomous Region is explored from a socio-political perspective. Second, China's human rights violations against Uyghurs and other Turkic Muslims are discussed. Third, crimes against humanity and the issue of genocide have been presented in its various aspects. Finally, the study tries to answer the question of whether China's human rights violations against Uyghurs and other Turkic Muslims constitutes a genocide. The study was prepared in the light of the data obtained through document analysis. The necessity of examining the ongoing human rights violations against Uyghurs and other Turkic Muslims, which seems to be gaining a different dimension, has laid the groundwork for this study.

ULUSLARARASI HUKUK KAPSAMINDA ÇİN’İN UYGUR VE DİĞER TÜRKÎ MÜSLÜMANLARA YÖNELİK İNSAN HAKLARI İHLALLERİNİN SOYKIRIM BAĞLAMINDA İNCELENMESİ

Öz

Bu çalışmada, uluslararası hukuk kapsamında Çin’in Uygur ve diğer Türkî Müslümanlara yönelik insan hakları ihlalleri soykırım bağlamında analiz edilmiştir. Çalışma dört başlık altında incelenmiştir. Buna göre, sırasıyla, Sincan Uygur Özerk Bölgesi sosyal ve siyasî bir perspektifle açıklanmış; Çin’in günümüzde Uygur ve diğer Türkî Müslümanlara yönelik insan hakları ihlalleri ele alınmış; insanlığa karşı suçlar ve soykırım meselesi çeşitli yönleriyle ortaya konmuş; sonuç olarak, Çin’in Uygur ve diğer Türkî Müslümanlara yönelik insan hakları ihlallerinin soykırım teşkil edip etmediği sorusuna cevap verilmeye çalışılmıştır. Çalışma, doküman analizi yapılarak elde edilen veriler ışığında hazırlanmıştır. Uygur ve diğer Türkî Müslümanlara yönelik devam etmekte olan ve git gide farklı bir boyut kazanmaya başladığı izlenimi uyandıran söz konusu insan hakları ihlallerinin incelenmesinin gerekliliği, bu çalışmanın yapılmasına zemin hazırlamıştır.
