Cinayət Təqibinin Mərhələləri (Nəzəri Mülahizələr)

Öz

Bu məqalədə qeyd olunur ki, cinayət təqibi prosessual fəaliyyətdir, cinayət təqibinin başlanması onun inkişaf mərhələlərini fərqləndirməyə imkan yaradır. Hesab edilir ki, cinayət təqibi üzrə fəaliyyətin mərhələləri məsələsində yanaşma tətbiq edilməlidir. Məqalədə hüquq ədəbiyyatında cinayət təqibinin mərhələləri ilə bağlı həm klassik cinayət prosesi nümayəndələri, həm də müasir tədqiqatçıların yanaşmalarının müqayisəli təhlili aparılır. Geniş nəzəri təhlillər əsasında belə nəticəyə gəlinir ki, Cinayət təqibinin mərhələli fəaliyyət kimi nəzərdən kecirilməsi vacibdir. Onun iki - məhkəməyədək icraat və məhkəmə icraatı üzrə diferensiallaşmış şəkildə həyata keçirilməsi qanunvericilikdə nəzərdə tutulur və hər bir mərhələnin özünəməxsus cəhətlərinin bu fəaliyyətə təsiri labüddür. Bu fəaliyyətin məzmun elementləri ilə bağlı müxtəlif yanaşmalar olmasına baxmayaraq hesab edilir ki, nəzəri yanaşma düzdür, tədqiqatın ana xəttinin müəyyən edilməsinə və təcrübi fəaliyyətin səmərəliliyinə xidmət edir.

Stages of Criminal Prosecution (Theoretical Reflections)

This article notes that criminal prosecution is a procedural activity and the initiation of a criminal case allows us to identify the stages of its development. It is believed that the approach to the phases of criminal prosecution should be applied. The article provides a comparative analysis of the approaches of both classical and modern researchers to the stages of criminal prosecution in the legal literature. On the basis of extensive theoretical examinations, it is significant to consider criminal prosecution as a step-by-step process. Its implementation is differentiated in two ways - pre-trial proceedings and judicial proceedings, and the influence of the specifics of each stage on this activity is inevitable. Although there are different approaches to the content elements of this activity, it is believed that the theoretical approach is correct, and serves to determine the main direction of research and the effectiveness of experimental activities.
