ULUSLARARASI İNSAN HAKLARI HUKUKU VE DİPLOMATİK HİMAYE HAKKI

Öz

İnsan haklarının uluslararası korunmasının gelişiminin, diplomatik himaye kurumunun işlevselliği ve temel kuralları üzerindeki etkileri, son yıllarda yoğun bir tartışma konusu haline gelmiştir. Bu alanda geleneksel anlayışın ifade ettiği düşüncelerin aksine, diplomatik himaye mekanizması ile insan hakları mekanizmalarının birbirini destekleyen ve karşılıklı etkileşim içinde olan mekanizmalar olduğu artık geniş ölçüde kabul edilmektedir. Böylece bir yandan, diplomatik himaye insan hakları alanında koruyucu bir rol üstlenirken, diğer yandan da insan hakları hukuku diplomatik himayenin niteliğini ve kullanım koşullarını etkilemektedir. Bu çalışmanın amacı, diplomatik himaye ile insan hakları arasındaki etkileşimin niteliğine ve boyutlarına ışık tutmaktır

International Human Rights Law and Diplomatic Protection

Öz

The development of the safeguarding of international human rights and the functioning of the institution of diplomatic protection and their effects on fundamental rules, has become an issue of contention in recent years. It is now widely accepted that the mechanisms of diplomatic protection and human rights support and mutually affect each other, contrary to the traditional views held in this field. While undertaking the protection of human rights on one hand, on the other it is affecting the characteristics of diplomatic protection and the rules of its use. The aim of this work is to highlight the characteristics and dimensions of the interaction between diplomatic protection and human rights
