Kolonyalizm ve Düzeltici Adalet Yaklaşımları

Öz

Geçmişte bir topluluğun bir başkasına karşı gerçekleştirdiği (soykırım, sürgün, köleleştirme, toprağa ve mallara el koyma gibi) haksız muameleler sebebiyle doğan zararların düzeltici adalet çerçevesinde ele alınması akademik yazında yeni bir eğilim değildir. Kolonyalizmden doğan zararlar da benzer şekilde düzeltici adalet tartışmaları ışığında değerlendirilmiş ve çeşitli düzeltici adalet yaklaşımları kolonyalizmin zararlarının nasıl düzeltileceğine dair argümanlar ortaya koymuşlardır. Kolonyal telafi savunucuları, kolonyalizmin varlığını devam ettirmesi, verilen zararların hesaplanmasının zorluğu ve kimi zararların telafisinin mümkün olmadığı gibi sorunları ihmal ettikleri gerekçesiyle eleştirilmişlerdir. Bu çalışmada düzeltici adalet yaklaşımlarının kolonyalizmden doğan zararlara yönelik ileri sürdükleri telafi yöntemleri ve formlarının öne sürülen eleştirilerle birlikte tartışılması amaçlanmaktadır.

Colonialism and Rectificatory Justice Approaches

Öz

Addressing the harms of past injustices (e.g. genocide, exile, enslavement, taking of land and property) committed by one community against another within the frame of rectificatory justice is not a new tendency in academic literature. Similarly, harms caused by colonialism were considered in the light of rectificatory justice and various rectificatory justice approaches put forward arguments about possible ways to rectify harms of colonialism. Defenders of colonial reparations were criticized for neglecting the continuity of colonialism, the difficulty of calculating harms and the impossibility of repairing certain harms. The purpose of this article is to discuss the methods and forms of reparations suggested by rectificatory justice approaches with the criticism they faced.
