AVRUPA BİRLİĞİ İÇ PAZARINDA ÇEVRENİN KORUNMASI

Öz

Avrupa Birliği (AB) iç pazarı, “… içinde malların, kişilerin, hizmetlerin ve sermayenin serbest dolaşımının sağlandığı, iç sınırların olmadığı bir alan”dır. İç pazara erişmek için serbest dolaşımına yönelik engelleri ortadan kaldırmak gerekir. Bunun için iki tenik mevcuttur: AB yetkilendirildiği ölçüde tüm üye devletlerde geçerli ortak kurallar getirebilir (pozitif bütünleşme) ve/veya üye devletler, AB çapında ortak kuralların yokluğunda, kendi kuralları ile hareket edebilir, ancak serbest dolaşıma yönelik haklı gösterilemeyen engel oluşturmamalıdır (negatif bütünleşme). Öte taraftan çevre ile ilgili endişeler günümüzde giderek artmakta olup “dünyadaki en büyük ekonomi” olarak tarif edilen AB’nin iç pazarı ile çevrenin korunması arasındaki ilişki önem taşımaktadır. Bu çalışma, bu arka planda, pozitif bütünleşme ve negatif bütünleşme çerçevesinde AB iç pazarında çevrenin korunmasını incelemeyi, böylelikle AB iç pazarı ile çevrenin korunması arasındaki ilişkiyi hukuki açıdan bütünlüklü bir biçimde ortaya koymayı amaçlamaktadır.

Protection of the Environment in the European Union Internal Market

Öz

European Union (EU) Internal Market is an “area without internal frontiers in which the free movement of goods, persons, services and capital is ensured”. In order to attain the internal market, the obstacles to the free movement should be removed. There are two techniques for this: EU can bring common rules valid in all of the Member States as far as it has competence to do so (negative integration) and/or in the absence of common rules throughout the EU, Member States can act with their own rules, however, they cannot constitute unjustified obstacles to the free movement (negative integration). On the other hand, nowadays, considerations related to environment have been rising gradually and the relationship between the EU’s internal market, which is defined as “the worlds biggest economy”, and protection of the environment gains importance. Against this background, this paper aims to scrutinise the protection of the environment within the EU internal market, in the framework of positive and negative integration, thus present the relationship between the EU internal market and protection of the environment comprehensively from a legal perspective.
