VENEDİK KOMİSYONU: KURULUŞU, İŞLEYİŞİ VE ETKİLERİ ÜZERİNE ANAYASAL BİR DEĞERLENDİRME

Öz

Anayasal dönüşüm, yalnızca yeni bir anayasanın kabul edilmesine değil, insan haklarını ve hukukun üstünlüğünü esas alan anayasal düzenin fiilen hayata geçirilmesine bağlıdır. Bu bağlamda hem yeni hem de yerleşik demokrasilerde gözlemlenen yapısal zorluklar ve demokratik gerileme temayülleri, anayasal konulara ilişkin bir rehber kurum ihtiyacını derinleştirmiştir. Bu makale, Venedik Komisyonu’nun anayasa hukuku alanındaki rolünü ve işlevini incelemek amacıyla yazılmıştır. Bu bağlamda öncelikle Komisyon’un kuruluşuna zemin hazırlayan tarihi ve hukuki zemin açıklanmış, misyonu ele alınmıştır. Akabinde Komisyon’un kurumsal yapısı, çalışma usulü ve metodolojik yaklaşımı incelenmiştir. Son bölüm ise Komisyon’un normatif rehberlik gücününün değerlendirmesine hasredilmiştir. Çalışma Venedik Komisyonu’nun meşruiyetinin, etkinliğinin ve uluslararası anayasal standartların oluşumundaki rolünün analiziyle sonlanmıştır.

THE VENICE COMMISSION: A CONSTITUTIONAL ASSESSMENT OF ITS ESTABLISHMENT, FUNCTIONING AND IMPACT

Abstract

Constitutional transformation depends not only on the adoption of a new constitution, but also on the effective implementation of a constitutional order based on human rights and the rule of law. In this context, the structural challenges and tendencies toward democratic backsliding observed in both new and established democracies have deepened the need for a guiding institution on constitutional matters. This article aims to examine the role and function of the Venice Commission in the field of constitutional law. In this context, the historical and legal background that paved the way for the establishment of the Commission is first explained, and its mission is discussed. Subsequently, the institutional structure, working procedures, and methodological approach of the Commission are examined. The final section is devoted to assessing the Commission's normative guidance power. The study concludes with an analysis of the Venice Commission's legitimacy, effectiveness, and role in the formation of international constitutional standards.
