Bağımsız Çalışanlar İçin İşsizlik Koruması: Belçika ve Türkiye Örneklerinin Karşılaştırmalı Analizi

Bu çalışma, serbest meslek sahiplerine yönelik işsizlik korumasını sosyal güvenlik perspektifinden inceleyerek Belçika’da uygulanan “bridging right” (geçiş hakkı) sistemi ile Türkiye’deki Esnaf Ahilik Sandığı uygulamasını karşılaştırmalı olarak analiz etmeyi amaçlamaktadır. Araştırmada öncelikle Türkiye’de bağımlı ve bağımsız çalışanlar için oluşturulan işsizlik koruma mekanizmaları ele alınmakta, ardından Belçika sosyal güvenlik sistemi içinde yer alan işsizlik sigortası ve serbest meslek sahipleri için geliştirilen geçiş hakkı mekanizması analiz edilmektedir. Çalışma kapsamında söz konusu iki sistem kapsam, yararlanma koşulları, sağlanan haklar ve finansman açısından karşılaştırılmaktadır. Bulgular, Türkiye’de Esnaf Ahilik Sandığı’nın işsizlik sigortasının bağımsız çalışanlara uyarlanmış bir modeli olduğunu, Belçika’da ise serbest meslek sahiplerine yönelik korumanın daha sınırlı ancak kriz dönemlerinde esnek şekilde genişletilebilen bir destek mekanizması şeklinde tasarlandığını göstermektedir. Çalışma, serbest meslek sahiplerinin işsizlik riskine karşı korunmasının giderek önem kazandığını ve sosyal güvenlik sistemlerinin değişen çalışma biçimlerine uyum sağlayacak şekilde yeniden tasarlanması gerektiğini ortaya koymaktadır.

This study aims to examine unemployment protection for the self-employed from a social security perspective, and to conduct a comparative analysis of the ‘bridging right’ system implemented in Belgium and the Artisan Solidarity Fund scheme in Turkey. The research first examines the unemployment protection mechanisms established for dependent and self-employed workers in Turkey, followed by an analysis of the unemployment insurance within the Belgian social security system and the bridging entitlement mechanism developed for the self-employed. Within the scope of the study, the two systems are compared in terms of coverage, eligibility conditions, benefits provided and financing. The findings indicate that in Turkey, the Artisan Solidarity Fund constitutes an adapted model of unemployment insurance for self-employed workers, whereas in Belgium, the protection for the self-employed is designed as a support mechanism that is more limited but can be flexibly expanded during periods of crisis. The study highlights that protecting the self-employed against the risk of unemployment is becoming increasingly important and that social security systems need to be redesigned to adapt to changing forms of work.
