JEAN BODIN’İN SİYASET FELSEFESİNDE DEVLET VE EGEMENLİK

Öz

Modern devlet teorisinin temel ilkesine göre, devlet, kendi yetki alanı
içinde hukukun en üstün ve tek kaynağıdır. Bu ilkeyi ilk defa, Les Six Livres de
la Republique (1576) adlı eserinde Fransız siyaset felsefecisi Jean Bodin ileri
sürmüştür. Bu ilke daha önceki çağlarda Roma Hukukunda legibus solutus ya
da suprema lex ile ve 13.yüzyıl Kilise hukukçularının Papaya ve imparatora
atfettikleri “plenitudo potestatis” niteliği ile ilan edilmiş olsa da, Bodin’in
egemenlik teorisi devrim niteliğindedir. Bodin’e siyaset felsefesi alanında
devrimci sıfatının verilmesine neden olan temel özellik, ondan önce kimsenin
egemenlik ilkesini açık bir şekilde tanımlamamış ve onun ortaya koyduğu bir
içerikte savunmamış olmasıdır. Ortaçağ hukuk anlayışına göre, prensin yasa
yapma ve değiştirme yetkisi olmasına rağmen, aynı prens mevcut yasaları
korumak ve onlara uymakla yükümlüydü. Fakat Bodin, teorisi ile egemene geniş
bir hareket sahası tanımıştır. Buna göre, egemen, istediği zaman yasa yapa-
bilmeli ve değiştirebilmelidir. Bu anlamda Bodin, egemenlik ilkesini mutlak ve
sürekli en üstün emretme gücü olarak tanımlamıştır. Bununla birlikte, egemen-
liğin mutlak olması onun sınırsız olduğu anlamına gelmemektedir. Egemen, ilahi
ve doğal yasalara uymakla yükümlüdür. Bodin, kendinden önceki teorisyenlerin
ele almadığı egemenlik ilkesini somut olarak tanımlamış ve dünyevi bir
meşruiyet zeminine oturtmuştur. Bodin’in egemenlik teorisi siyasal düşünce
tarihinde, hukuk düzeninin temelini mevcut yasalardan, yasa yapan prense
kaydıran kavramsal bir devrim olmuştur.
