SUPPLEMENTARY MEANS OF INTERPRETATION OF TREATIES IN INTERNATIONAL LAW

Although there are certain issues in the interpretation of treaties in international law, it is important to interpret treaties correctly in order to determine the meaning of treaty provisions and ensure a consistent application.nThe rules of treaty interpretation play an important role in finding the correct meaning of treaty provisions, which is crucial in resolving a dispute. The rules governing the interpretation of treaties in international law are found in Articles 31 to 33 of the 1969 Vienna Convention on the Law of Treaties (VCLT). Article 31 addresses the general rule of interpretation, while Article 32 specifies supplementary rules of interpretation. In some cases, the general rule of interpretation may not be sufficient to interpret a treaty or may lead to an ambiguous result. Therefore, the interpreter may need to resort to supplementary means of interpretation. Supplementary interpretation rules include the preparatory work and circumstances of the conclusion of a treaty and may be used to assist in the interpretation of treaties. This study examines the role of supplementary interpretation rules in the treaty interpretation process based on the provisions of Article 32 of the VCLT. The purpose of this study is to explain what it means to interpret a treaty using supplementary interpretation rules. Therefore, the importance of the supplementary interpretation rules set out in the VCLT will be discussed. The study argues that the supplementary interpretative rules of the VCLT are useful in interpreting treaties.

Uluslararası hukukta antlaşmaların yorumlanmasında bazı sorunlar olmakla birlikte belli bir uygulama sağlamak üzere antlaşma hükümlerinin anlamını tespit etmede antlaşmaları doğru yorumlamak önemlidir. Antlaşma yorumlama kuralları bir uyuşmazlığın giderilmesinde kritik olan antlaşma hükümlerinin doğru anlamını bulma bakımından önemli bir rol oynamaktadır. Uluslararası hukukta antlaşmaların yorumlamasına ilişkin kurallar 1969 Viyana Antlaşmalar Hukuku Sözleşmesi’nin (VAHS) 31 ila 33. maddelerinde yer almaktadır. 31. madde genel yorumlama kuralını ele alırken, 32. madde tamamlayıcı yorum kurallarını belirtmektedir. Bazı durumlarda, genel yorumlama kuralı bir antlaşmayı yorumlamada yeterli olmayabilir veya belirsiz bir sonuca yol açabilmektedir. Bu nedenle, yorumcunun tamamlayıcı yorum araçlarına başvurması gerekebilir. Tamamlayıcı yorum kuralları bir antlaşmanın hazırlık çalışmaları ve imzalanma koşullarını içermekte olup antlaşmaların yorumlanmasına yardımcı olmak amacıyla kullanılabilir. Bu çalışmada VAHS’nin 32. maddesinin hükümlerine dayalı olarak antlaşma yorumlama sürecinde tamamlayıcı yorum kurallarının rolü incelenmektedir. Söz konusu çalışmanın amacı, tamamlayıcı yorum kurallarını kullanarak bir antlaşmayı yorumlamanın ne anlama geldiğini açıklamaktır. Bu nedenle, VAHS’de belirlenen tamamlayıcı yorum kurallarının önemi ele alınacaktır. Çalışmada, VAHS’nin tamamlayıcı yorum kurallarının antlaşmaların yorumlanmasında yararlı olduğu savunulmaktadır.
