CRIME OF PRODUCTION OR SALE OF MEDICINE THAT RISK THE LIFE AND HEALTH OF PEOPLE (Article 187 of the Turkish Penal Code)
Öz
This study examines the offence of manufacturing or selling medicines in a manner that endangers human life and health (Article 187 of the Turkish Penal Code), which is also referred to in the literature as one of the pharmaceutical counterfeiting offences. Within this framework, the regulation of the offence under the former Turkish Penal Code No. 765 is examined, followed by a comparison with similar offences, an analysis of the legal interest protected by the provision, and a detailed discussion of the material elements of the offence, the mental element, unlawfulness, special forms of commission, aggravated circumstances, and the procedural characteristics of investigation and prosecution. Furthermore, attention is drawn to the inconsistency between the title of the provision and its actual content. The study also argues that the concept of “medicine,” which constitutes the material subject of the offence, lacks a clear definition in terms of its content and scope, making it open to interpretation in a way that may also encompass certain food and cosmetic products. In addition, considering the rapid development of the pharmaceutical industry and the growing significance of medicines in healthcare, the absence of a constitutional norm serving as a foundation for pharmaceutical law is criticized. In this respect, the study highlights the need for an independent Pharmaceutical Law, as found comparative law and addresses the problems arising from the fragmented and inconsistent nature of the current legislation. Finally, the study identifies the issues raised by the current wording of Article 187 in terms of the principle of legality and offers proposals for legislative reform to address these concerns.
