Romanlar Azınlığı ve Avrupa Birliği Hukukunda Serbest Dolaşım Hakları

The European Union placing more emphasis increasingly with each passing day on democratic elements and factors of respect of human rights exhibits this sensibility in the matter of respect of minority rights, too. What have been experienced in the year 2010 constitute an example to this. The European Commission initiated a procedure of violation, by having serious doubts on the subject whether the policy the French Government was pursuing versus the Romas, who are a minority was conforming with the principle of free movement of people or not. It is required to scrutinize the free movement of Union citizens and restrictions to it under the titles of Romas’ situation, French legislation, the risk of injury to fundamental liberties. In fact, it is necessary to examine more closely the Romas, which are also a significant ethnicity at the same time. And the determination of a serious policy is required, so to ensure the adjustment socially of this minority to the Union and economically

Demokratik öğelere ve insan haklarına saygı konularına gün geçtikçe daha fazla önem veren Avrupa Birliği (AB), azınlık haklarına saygı hususunda da bu hassasiyetini her fırsatta göstermektedir. 2010 yılında yaşananlar da bunun bir örneğidir. Avrupa Komisyonu, Fransız Hükümetinin azınlık olan Romanlar karşısında izlediği politikanın, kişilerin serbest dolaşım ilkesine uygun olup olmadığı konusunda ciddi kuşkular duyarak ihlal prosedürü başlatmıştır. Bu konuyu birlik vatandaşlarının serbest dolaşımı ve sınırları, Romanların durumu ve Fransız yasaları, temel özgürlüklere halel gelmesi riskleri başlıkları altında incelemek gerekmektedir. Aslında aynı zamanda önemli bir etnik köken olan Romanları daha yakından incelemek önemlidir. Bu azınlığın Birliğe sosyal ve ekonomik olarak uyum sağlaması için de ciddi bir ortak politika belirlemek gerekmektedir
