The Attitudes and Behaviours Which Have Established as a Rule and Punishment of the Ehl-i Örf and Ehl-i Sharia in the Ottoman Empire
Abstract
Ottomans, through the Oghuz Khan tradition, were affected by the political, administrative, military, and financial structures of the Turk-Islamic states as well as by political and cultural characteristics of different civilizations in the regions had conquered. They did not submit to uniformity their administrative system, which had evolved from a conventional one into dogmas. Their attachment to conventional values and their being open to innovations enabled them to establish a unique civilization. In the operability of such an administrative system, Ehl-ı örf–laws produced in the light of İslam- and Ehl-i ser’–religious rules -played undeniable roles. As for the behaviour of these institutions, it has been identified through both written and unwritten rules. Maximum observation of örf-i and şer’ provisions, and the discipline and hierarchy being kept in the foreground rendered operability to the conscript and management of a huge army. During the second half of the 16th century, degeneration of hierarchy and discipline, non-observance of traditional and sharia values generally resulted in great discomfort among the citizens. Central administration tried to eliminate the problems by providing the supervision mechanism with operability to rectify the situation. However, increasing supplies indicated that the situation requiring training and prevention did not disappear. This situation suggested that the central administration began to lose its power and influence in rural areas, as a result of the deterioration of the kanûn-ı kadîm (punitive, administrative, and financial laws imposed by the sultan in conformity to şer’) and ehl-ı şer’, and that the staff in these institutions, taking advantage of the situation, obtained additional income by abusing their duties and authorities. In this context, this issue has to be investigated in order to understand the positive or negative reflections of the rule of law and the failure to adhere to the rules of law in the process from the death of the ahl-iörf and the ehl-ı şer to its tazir. From Kanunî, until III. Mehmed, ehl-ı örf and ehl-i şer’ non-compliance with the law and customs, and the penalties applied to them; diwan records were used as the main source because they were researched in the context of the submissions presented to the diwan.
