Conceptual and Legal Evaluation of Quiet Quitting for Public Servants

Öz

One of the most popular concepts in recent times in working life is quiet quitting. Although the concept frequently appears in the studies of organizational behavior scholars, its legal and ethical dimensions have often been neglected. In particular, there has been little legal evaluation of quiet quitting in the context of public officials. However, quiet quitting is a significant issue for public servants. Therefore, it is important to define the concept of quiet quitting as it relates to public officials and to evaluate it from a legal perspective. In the present study, the concepts of quiet quitting and public officials are first introduced based on existing literature. Subsequently, the phenomenon of quiet quitting is examined in relation to public servants, and its legal implications are analyzed. Finally, the ethical aspects of quiet quitting are discussed. The study concludes that quiet quitting may lead to disruption of public services, reduced service quality, and a negative impact on employee performance. In addition, by briefly addressing the organizational and individual factors that lead to quiet quitting, it is emphasized that the process is not solely an employee-driven attitude but also a result of managerial practices. In this context, the disciplinary consequences of quiet quitting should be assessed based on the specific circumstances and manifestations of the behavior in each case. Additionally, during the quiet quitting process, various ethical violations may occur on the part of both employees and the administration/employers and managers. In order to prevent the spread of quiet quitting among public officials, legal clarity in job descriptions should first be ensured, followed by the adoption of a participatory management approach. The development of effective performance and reward systems, along with the strengthening of institutional ethical culture, will enhance the motivation of public officials and help reduce quiet quitting behavior.

KAMU GÖREVLİLERİ İÇİN SESSİZ İSTİFANIN KAVRAMSAL VE HUKUKİ DEĞERLENDİRMESİ

Öz

Çalışma hayatında son dönemin en popüler kavramlarından bir tanesi sessiz istifadır. Kavram örgütsel davranış bilimcilerinin çalışmalarında sıklıkla yer bulmasına karşın konunun hukuki ve etik yönleri kısmen ihmal edilmiştir. Özellikle kamu görevlileri özelinde hukuki değerlendirmesine rastlanmamıştır. Ancak sessiz istifa, kamu görevlileri açısından önemli bir konudur. Bu nedenle, sessiz istifa kavramının kamu görevlilerindeki yerinin kavramsal olarak ifade edilmesi ve hukuki olarak değerlendirilmesi önem arz etmektedir. Mevcut çalışmada, öncelikle sessiz istifa ve kamu görevlisi kavramları literatürden yararlanılarak tanıtılmakta, devamında sessiz istifa kavramı kamu görevlileri açısından ele alınmakta ve hukuki sonuçları değerlendirilmektedir. Son olarak, sessiz istifanın etik yönleri yorumlanmaktadır. Sonuç olarak, sessiz istifanın kamu hizmetinin aksamasına, hizmet kalitesinin düşmesine neden olabileceği ve çalışanın performansını olumsuz etkileyebileceği değerlendirilmektedir. Ayrıca sessiz istifayı ortaya çıkaran örgütsel ve bireysel faktörlere kısaca değinilerek, sürecin yalnızca çalışan kaynaklı bir tutum değil, aynı zamanda yönetimsel uygulamaların bir sonucu olduğu vurgulanmaktadır. Bu kapsamda sessiz istifanın disiplin hukuku açısından neticeleri, sessiz istifa davranışının yansımaları üzerinden ve her olayın özelinde irdelenmesi gerekmektedir. Ayrıca sessiz istifa sürecinde hem çalışanlar hem de idare/işveren ve yöneticiler açısından birtakım etik ihlaller söz konusudur. Sessiz istifanın kamu görevlileri arasında yaygınlaşmasını önlemek için öncelikle görev tanımlarında hukuki belirlilik sağlanmalı, ardından katılımcı yönetim anlayışı benimsenmelidir. Etkin performans ve ödüllendirme sistemlerinin geliştirilmesi ile birlikte kurumsal etik kültürün güçlendirilmesi, kamu görevlilerinin motivasyonunu artırarak sessiz istifa davranışını azaltacaktır.
