Öz

Müteaddit uluslararası örgütler memurlarıyla aralarındaki istihdam ilişkisinden kaynaklanan hukukî ihtilâfların kesin sûrette halliyle görevli özel organlar tesis etmişlerdir. Pratikte münferiden muhtelif şekillerde adlandırılabilen bu merciler genel olarak uluslararası idâre mahkemeleri tabiriyle anılmaktadırlar. Uluslararası idâre mahkemelerinin ortaya çıkışı Milletler Cemiyetine dayanmakla beraber, bu yargı mercileri İkinci Dünya Savaşı sonrasında uluslararası örgütlerin sayısının artmasına koşut olarak niceliksel ve yapısal düzlemlerde büyük bir gelişim göstermiştir. Bu bağlamda uluslararası idâre mahkemelerinin bağımsızlığını ve profesyonelliğini güçlendiren, işleyişlerini daha süratli ve şeffaf kılmayı hedefleyen düzenlemeler benimsenmiştir. Uluslararası idâre mahkemeleri uluslararası örgütler ile memurları arasındaki ihtilâfların hukuk çerçevesinde hallini sağlayan bağımsız ve tarafsız yargı mercileri olarak uluslararası memurların özlük haklarının korunmasına hizmet eden organlardır. Bu itibarla uluslararası örgütlerin verimli ve etkili işleyişi bakımından önemli bir rol oynamaktadırlar.
