In this study, Carl Schmitt’s exceptional theory is read through Giorgio Agamben. Agamben portrayed a different exception, starting from Schmitt’s political conception and his understanding of sovereignty. According to Agamben, the exception is not an unusual phenomenon. In the period we lived, the exceptional state became a rule beyond being an exclusionary state. Sovereign and homo sacer constitute the two extremes of this unjustified space area where state of exception has become the ideal situation. In the face of the sovereign, the ruler of the exceptional case, everybody is homo sacer who lives bare lives. Army which may be murdered with impunity that can be killed but not sacrificed.
