EVALUATION OF THE CONCEPTS OF DUTY, AUTHORITY AND MEDIATION IN TERMS OF PSYCHOLOGICAL HARASSMENT

Öz

In civil litigation, jurisdiction is a concept that determines which court in the region will handle a legal case. The rules of jurisdiction do not differ in terms of quality in labor litigation compared to civil litigation. However, since labor disputes are of a special nature, labor courts are generally specialized courts responsible for resolving labor disputes. Such disputes are specific conflicts defined by law, with identifiable parties and subject matter, and are expected to be resolved by the courts. The duties of labor courts are regulated by Article 5 of the Labor Courts Law (İMK). The concept of competence in civil litigation determines which labor court will hear a case. In labor litigation, the concept of competence has diverged from the rules regarding the authority of courts in civil litigation and has introduced some special regulations. The concept of mediation was first included in our law by the Mediation Law in Civil Disputes (HUAK). Initially, this law regulated mediation as a voluntary method of resolution for labor disputes, but it has since become a mandatory practice alongside the Labor Courts Law. Our study aims to determine which court is competent and authorized in cases of psychological harassment and to provide information on the applicability of the mediation institution in these cases.

Görev, Yetki ve Arabuluculuk Kavramlarının Psikolojik Taciz Açısından Değerlendirilmesi

Öz

Medeni yargılamada görev, bir hukuk davasına o bölgedeki hukuk mahkemelerinden hangisinin bakacağını belirleyen bir kavramdır. Görev kuralları nitelik bakımından iş yargılamasında da medeni yargılamadan farklılık göstermemektedir. Ancak iş uyuşmazlıkları özel nitelikli ihtilaflar olduğundan iş mahkemeleri kural olarak iş ihtilaflarını çözmekle görevli ihtisas mahkemeleri niteliğine sahiptir. Bu tür uyuşmazlıklar, kanun tarafından tarafları ve konusu belirli olan ve mahkemeler tarafından çözümlenmesi öngörülen özel nitelikteki anlaşmazlıklardır. Medeni yargılamada yetki kavramı ise, bir davanın hangi yerdeki iş mahkemesi tarafından görüleceğini belirlemektedir. İş yargılamasında yetki kavramı, medeni yargılamadaki mahkemelerin yetkisine ilişkin kurallardan ayrılmış ve bazı özel düzenlemeler getirmiştir. Arabuluculuk kavramı ise, kanun koyucu tarafından hukukumuza ilk kez Hukuk Uyuşmazlıklarında Arabuluculuk Kanunu (HUAK) ile dâhil edilmiştir. Başlangıçta bu kanun, arabuluculuğu iş uyuşmazlıkları için isteğe bağlı bir çözüm yöntemi olarak düzenlemişken, İş Mahkemeleri Kanunu ile birlikte zorunlu uygulama haline getirmiştir. Çalışmamız, psikolojik taciz davalarında hangi mahkemenin görevli ve yetkili olduğunu belirlemeyi ve arabuluculuk kurumunun bu davalarda uygulanabilirliği hakkında bilgi sunmayı amaçlamaktadır. Çalışmamızda psikolojik taciz davalarında görevli mahkemenin İş Mahkemeleri, yetkili mahkemenin ise genel yetkili kuralı gereğince öncelikle davalı gerçek veya tüzel kişinin davanın açıldığı tarihteki yerleşim yeri mahkemesi, psikolojik taciz eyleminin haksız fiil olarak değerlendirilmesi durumunda haksız fiilin işlendiği veya zararın meydana geldiği yahut gelme ihtimalinin bulunduğu yer ya da zarar görenin yerleşim yeri mahkemesi, iş kazası sayılması halinde ise iş kazasının veya zararın meydana geldiği yer ile zarar gören işçinin yerleşim yeri mahkemesinin yetkili olacağı ve arabuluculuk kurumu bakımından İş Mahkemeleri Kanunu (İMK) m.3/1 uyarınca psikolojik tacize bağlı tazminatlarda arabuluculuğa başvurulmasının yasal zemine kavuştuğu, ayrıca İMK m.3/3 uyarınca arabuluculuğun uygulanmayacağı konular arasında psikolojik taciz sayılmaması nedeniyle psikolojik taciz mağduru olduğunu iddia eden herkesin ve psikolojik taciz uygulayan kimselerin de dava açmadan önce arabulucuya başvurabilme hakkına sahip olması gerektiği sonuçlarına ulaşılmıştır.
