From the regulation of “Turkish law shall apply to all criminal offences committed in Turkey” stated in 8th article of Turkish Penal Code (TPC), it is reached to the conclusion that in addition to citizens committed crime within borders of country of Turkey (All places accepted as country soil including territorial waters and airspace) Turkish Penal Code will also be applied for foreigners. Besides, there is provision in 4th article of TPC stating “Ignorance of the penal codes can not be deemed as an excuse”. While “Principle that Ignorance of law can not be deemed as an excuse” was accepted as one of the fundamental rules of criminal law, in time it was seen that application of this principle to both citizen and the foreigner in a solid way gave rise to unjust outcomes. It is more probable that foreigners who begin to reside in another country either permanently or temporarily do not know about applicable penal laws with respect to a citizen. It must have been also accepted by legislator that application of principle that “Ignorance of law can not be deemed as an excuse” without exceptions gives rise to unjust outcomes since regulation in article 30/4 of TPC has been specified. According to article 30/4 of TPC, any person who makes an inevitable mistake about whether his act was unjust or not shall not be punished. When judicial decisions in Turkey are reviewed, it must be stated that this provision is rarely applied. Especially whether article 30/4 be applied for migrants residing in our country after escaping from internal war in Syria or not has become frequently debated.
