Meşru Müdafaanın Aciliyet Koşulu ve 2020 İkinci Karabağ Savaşı

Öz

Eylül 2020'de, Azerbaycan ordusu, Karabağ'ı çevreleyen ve 1992-1994 Birinci Karabağ Savaşı’ndan bu yana Ermenistan'ın hukuka aykırı bir şekilde elinde tuttuğu Azeri topraklarının büyük bölümünü geri alan büyük bir saldırı başlattı. Uluslararası hukukta meşru müdafaanın aciliyet koşulunun yerine getirilmesi için, silahlı saldırının ardından yanıtın makul bir süre içinde verilmesi gerekmektedir. Azerbaycan'ın eylemi, aciliyet koşulunu ihlâl etmemiştir. Çünkü Ermenistan, neredeyse 26 yıl boyunca Azerbaycan topraklarını saldırgan bir şekilde işgal etmeye devam etmiştir. Ermenistan'ın Azerbaycan ülkesini işgali, işgal devam ettiği sürece Azerbaycan'ın meşru müdafaa hakkını kullanmasına olanak tanıyan sürekli bir silahlı saldırı teşkil etmektedir.
