Öz
Certainly, the freedom of thought has been the most debatable subject in social sciences.
The main reason of this is that the question of whether development level of society
secures the freedom of thought or not has been evaluated directly. In this context, it s clearly
stated that the institutionalizing democracy depends on the freedom of thought. For Turkey
side, it is possible to say that this subject is an important in every aspect and even one of the
key subjects. Having gained the membership status in Helsinki Summit of 1999, maintaining
Copenhagen criteria’s and removing the barriers into the freedom of thought and expanding
the context of freedom of thought have dominate the agenda in Turkey. After accession partnership document as a map of way for integration and announcement of National Program
prepared for the condition of document, some amendments of constitution has been made for
the regulation of freedom of thought in order to successes of membership criteria’s in 2001
and some adaptation laws have been issued. In this study, in context to legal regulation in 2001, the
context and importance of freedom of thought in Turkish law system has been studied

ULUSAL PROGRAM VE TÜRKİYE’DE DÜŞÜNCE ÖZGÜRLÜĞÜ
Öz
Sosyal bilimler alanında en çok tartışılan konulardan biri hiç kuşkusuz düşünce özgürlüğü kavramıdır. Bunun da temel nedeni, toplumların gelişmişlik düzeylerinin düşünce özgürlüğünün güvence altına alınıp alınmaması sorusuyla doğrudan ilişkili olarak görülüp değerlendirilmesidir. Bu bağlamda, demokrasinin kurumsallaşmasının düşünce özgürlüğüne bağlı olduğu rahatlıkla söylenebilir. Türkiye açısından konuyu değerlendirilecek olursak, kavramın her açıdan önemli ve hatta kilit kavramlardan biri olduğunu söylemek olanaklıdır. Türkiye 1999’da Helsinki Zirvesinde aday ülke statüsünü elde ettikten sonra, Kopenhag siyasi kriterlerinin sağlanabilmesi için düşünce özgürlüğünün önündeki engellerin kaldırılması ve düşünce özgürlüğü alanının genişletilmesi gündemdeki yerini almıştır. Yol haritası olarak nitelendirilebilecek Katılım Ortaklığı Belgesi ve buna koşut hazırlanan Ulusal Program ilan edildikten sonra 2001 yılında üyelik kriterlerinin sağlanabilmesi için düşünce özgürlüğünü de düzenleyen anayasanın bazı maddelerinde değişiklikler olmuş ve bir dizi uyum yasaları çıkarılmıştır. Bu çalışmada, 2001 yılında yapılan yasal düzenlemeler bağlamında, düşünce özgürlüğünün Türk hukuk sistemi içindeki yeri ve önemi ele alınacaktır.
