YATIRIMCI DEVLET UYUŞMAZLIK ÇÖZÜM SİSTEMİ’NİN (ISDS) REFORMU BAKIMINDAN ÖNEMLİ BİR ADIM: TASLAK ETİK KURALLAR

Öz

Günümüzde yatırımcı devlet uyuşmazlık çözüm sistemi bağlamında en çok tartışılan ve uygulamada sorunlara yol açan hususlardan birisi de etik meselesidir. Bazı tahkim kurumlarının usul kurallarında etiğe ilişkin birtakım düzenlemelere yer verilmişse de söz konusu düzenlemeler sorunları çözecek yeterlilikte görünmemektedir. Zira, bu düzenlemeler yatırımcı devlet uyuşmazlık çözüm sistemi bakımından yeknesak ve bağlayıcı nitelikli bir etik kurallar bütünü teşkil etmemektedir. Söz konusu eksikliğin giderilmesini teminen bazı uluslararası kuruluşlarca etik konusunda çalışmalar yürütülmektedir. Uluslararası Yatırım Uyuşmazlıklarının Çözüm Merkezi (ICSID) ve Birleşmiş Milletler Uluslararası Ticaret Hukuku Komisyonu (UNCITRAL) Sekreteryalarının ortak çalışması neticesinde hazırlanan etik kurallar taslağı, ilgili taraflarla 1 Mayıs 2020 tarihinde paylaşılmıştır. Taslak kurallar; tarafsızlık, bağımsızlık, tahkim sürecinin adil, etkin ve medeni bir şekilde yürütülmesini sağlayacak yükümlülükler dahil olmak üzere karar verici ve karar verici adayları bakımından birtakım standart ve düzenlemeler içermektedir. Söz konusu taslak, yatırımcı devlet uyuşmazlık çözüm sistemi yönünden önemli bir eksikliği gidermenin yanı sıra diğer etik kurallardan farklı olarak bağlayıcı olması ve taslakta belirlenen yükümlülüklere aykırı hareket edilmesi halinde bir takım yaptırımların uygulanabilecek olması bakımından daha net bir yaklaşım sergilemektedir.

An Important Step for Reform of ISDS System: Draft Ethical Rules

Öz

Nowadays the issue of ethic is one of the subjects which are mostly discussed and causes problems in practice in the context of ISDS system. Even though there are certain arrangements with regard to ethic in procedural rules of some arbitration institutions, they are not sufficient to solve the problems. Because, these arrangements are not binding and uniform in terms of ISDS system. In order to fill the aforementioned deficiency, some international organisations are carrying out works. Draft ethical rules were prepared as a result of the joint work of ICSID and UNCITRAL Secretariats and shared with the interested parties on 1 May 2020. It regulates a set of standards and provisions for adjudicators and candidates for adjudicator, including impartiality, independence and obligations to ensure that the arbitration process is conducted in a fair, effective and civilized manner. The draft fills an important deficieny with regard to ISDS system and also exhibits a clearer approach, unlike the other ethic rules, in terms of being binding and imposing sanctions in case of breach.
