Digital Green Certificate As a New EU Regulation for Free Movement of Persons

Öz

Covid-19 has a transformative and shifting effect in the current global system, as experienced in previous pandemics of world history. From a public health perspective, free movement of persons become a prominent restricted concept during pandemic times. Just after one year of the Covid-19 pandemic, new regulations and implementations have been introduced to revive the free movement of persons. Publicly known as ‘vaccine passports or vaccine certificates’, European Commission has offered ‘Digital Green Certificate’ to normalize free movement within The EU borders with the digital application, which may refresh economy, politics, and social life and which may be articulated to EU’s political integration process. So, this article aims to analyze the possible effects of the Digital Green Certificate on the free movement of persons in the EU during the Covid-19 pandemic. As a method, official EU documents and discourses will be applied to define new vaccine passport and its potential contribution to the free movement of persons. International newspapers and opinion articles will be used as a secondary source, due to the uncertain structure of Covid-19 applications in nation-state-wide. This article aims to contribute to future studies in the field of free movement of persons and EU practices in still-continuing Covid-19 pandemia.

SERBEST DOLAŞIM BAĞLAMINDA AVRUPA BİRLİĞİ’NİN YENİ UYGULAMA ARACI: DİJİTAL YEŞİL SERTİFİKA

Öz

Covid-19 pandemisi, tarihte yaşanan diğer pandemiler gibi, günümüzde de uluslararası sistemi dönüştürücü bir etkiye sahiptir. Pandeminin ilk yılında kamu sağlığı açısından durma noktasına gelen kişilerin dolaşım serbestisi, son dönemlerde aşı üretimin hızlanması ve çeşitlenmesi ile birlikte farklı uygulamalarla tekrar canlandırılmaya çalışılmaktadır. Serbest dolaşımı önemli bir özgürlük alanı olarak kurucu antlaşmalarına işleyen ve siyasi bütünleşmesinin önemli bir parçası olarak gören Avrupa Birliği, Dijital Yeşil Sertifika önerisi ile bu hakkı güvenli ve kontrollü bir şekilde tekrar uygulamaya koymak ve yeni normal düzende dijital uygulamalarla ekonomik, siyasi ve toplumsal yapıyı tekrar hareketlendirmek istemektedir. Bu makale, Avrupa Komisyonu tarafından önerilen Dijital Yeşil Sertifika uygulamasını, serbest dolaşıma etkisi bağlamında incelemektedir. Araştırma yöntemi olarak ise, serbest dolaşıma ilişkin literatür analizi, Avrupa Birliği’nin resmi söylem ve dokümanlarının incelenmesi ve pandeminin halen gündemde olması ve sürecin belirsizliği sebebi ile de basın haberleri analizinden faydalanılmıştır. Aşı pasaportu, aşı sertifikası gibi farklı şekillerde de kamuoyu tarafından tanımlanan bu yeni uygulamanın Avrupa Birliği boyutu ile tanımlanması, serbest dolaşıma etkilerinin incelenmesi ve bu alanda gelecek dönemde yapılacak çalışmalara katkı sağlaması hedeflenmektedir.
