Şahsî Çoğaltma İstisnası ve Bulut Depolama Platformlarında Uygulanabilirliği

Öz

Eser sahibinin münhasır hakları karşısında üçüncü kişilerin eserden istifade etmeye ilişkin menfaatlerini de himaye eden telif hukuku, bu dengeyi -büyük ölçüde- istisna ve tahdit mekanizması üzerine inşa etmektedir. Şüphesiz, bunun en merkezi görünümlerinden biri de eserden doğan hakların sıklet merkezi olan çoğaltma hakkına, kişilerin bilimsel, kültürel ve sanatsal hayata katılımının temini adına getirilen şahsî çoğaltma istisnasıdır. Eserlerin üretimi, yayımı ve tüketiminde dijital ortamın birincil mecra haline geldiği günümüzde, dijital nüshaların oluşturulması ve depolanması noktasında birçok teknolojik alternatif sunulmaktadır. Mevcut çalışmada, 5846 sayılı Fikir ve Sanat Eserleri Kanunu’nun (FSEK) 38/1. maddesinde, birçok açıdan tefsire muhtaç bir düzenlemeye konu edilen şahsî çoğaltma istisnasının, bulut depolama platformlarında oluşturulan ve / veya saklanan dijital nüshalar bakımından uygulanabilirliği tartışılmaktadır. Bu bağlamda çoğaltma hakkı ve buna getirilen mezkûr istisnanın kapsam ve koşulları tespit edildikten sonra, Avrupa Birliği (AB) hukukundaki özdeş düzenlemenin bulut depolama alanları özelindeki içtihadî yorumlarından hareketle, Türk hukuku açısından da muteber olabilecek çıkarımlar yapılmaktadır.

Private Copying Exception and Applicability Thereof on Cloud Storage Platforms

Öz

In safeguarding the justifiable interests of third parties to access the work alongside the exclusive prerogatives of the author, copyright laws build a balancing mechanism relying -to a large extent- on exceptions and limitations. Frankly, one of the most central appearances of the latter is the private copying exception introduced to the right of reproduction -which marks the center of gravity in the copyright bundle- with a view to enabling the participation of individuals in scientific, cultural and artistic discourse. With the digital realm serving as the primary medium for the production, dissemination and consumption of works in contemporary landscape, many technological alternatives are available in generation and storage of digital copies. Against this background, the present study reflects on the applicability of the private copying exception, regulated in article 38/1 of the Law on Intellectual and Artistic Works (FSEK) No. 5846 in a manner that calls for clarification in many respects, within the specific context of digital copies created and/or stored on cloud storage platforms. In doing so, having delineated the scope and conditions of the right of reproduction and those of private copying exception, the study sets about drawing feasible conclusions for Turkish law, with a reference to the jurisprudential interpretations, in the specific to cloud storage platforms, of the equivalent legal provision under the European Union (EU) law.
