Öz

Bu makale, Franz Kafka’nın Yasanın Önünde adlı anlatısı ile Jacques Derrida’nın hukuk felsefesi arasında kurulan kavramsal ilişki üzerinden, hukukun aporetik yapısını incelemektedir. Çalışmanın temel amacı, hukuku kapalı ve normatif bir sistem olarak değil, öznenin bekleyiş, erteleme ve erişilemezlik deneyimi içinde kurulan bir ilişki biçimi olarak kavramsallaştırmaktır. Kafka’nın anlatısında yasa, içeriği açıklanan bir normlar bütünü olarak değil, kendisini sürekli geri çeken ve ancak dolaylı biçimde etkide bulunan bir otorite olarak sahneye çıkar. Bu yapı, hukukun evrensellik iddiası ile tekil öznenin deneyimi arasındaki gerilimi açığa çıkarır. Makale, Kafka’nın edebi sahnesinin, Derrida’nın yapısökümcü hukuk düşüncesiyle birlikte okunduğunda felsefi bir yoğunluk kazandığını göstermeyi amaçlamaktadır. Derrida’ya göre hukuk, kendisini nihai bir temele dayandıramayan, kökensel olarak temelsiz ve edimsel bir yapıya sahiptir. Hukukun meşruiyeti, önceden verilmiş bir ölçüte değil, karar anında ortaya çıkan ve gerekçelendirilemeyen bir zorunluluğa dayanır. Bu nedenle yasa ile adalet arasındaki ilişki yapısal olarak kapanmaz; adalet hukuka indirgenemez ve her zaman ertelenmiş bir imkân olarak kalır. Bu bağlamda makale, hukukun şiddet ve belirsizlikle kurulan bir yapıya sahip olduğunu savunmakta ve hukuku tamamen aşmanın ya da onun dışında bir kurtuluş alanı bulmanın mümkün olmadığını ileri sürmektedir. Kafka ve Derrida’nın birlikte okunması, hukuku ne mutlak biçimde meşrulaştıran ne de bütünüyle reddeden bir tutum önerir. Aksine bu okuma, hukukun kendi iç açmazlarını görünür kılarak, etik ve politik sorumluluğun tam da bu açıklık ve belirsizlik alanında ortaya çıktığını göstermektedir.

Kafka, Derrida, and the Aporia of the Law

Öz

This article examines the aporetic structure of law through the conceptual relationship established between Franz Kafka’s Before the Law and Jacques Derrida’s philosophy of law. The main aim of this article is to conceptualize law not as a closed and normative system, but as a form of relation constituted through the subject’s experience of waiting, deferral, and inaccessibility. In Kafka’s narrative, law does not appear as a set of norms with a clearly defined content; rather, it emerges as an authority that continually withdraws itself and operates only indirectly. This structure exposes the tension between law’s claim to universality and the singular experience of the subject. The article seeks to demonstrate that Kafka’s literary scene gains philosophical density when read together with Derrida’s deconstructive approach to law. According to Derrida, law possesses a performative and originary structure that cannot ground itself in any final foundation. The legitimacy of law does not rest on a pre-given criterion, but on a necessity that emerges at the moment of decision and remains unjustifiable. For this reason, the relationship between law and justice is structurally non-closable; justice cannot be reduced to law and always remains a deferred possibility. In this context, the article argues that law is constituted through violence and indeterminacy, and maintains that it is neither possible to fully transcend law nor to locate a sphere of salvation entirely outside it. Reading Kafka and Derrida together proposes a position that neither absolutely legitimizes law nor wholly rejects it. Rather, this reading renders visible the internal impasses of law and shows that ethical and political responsibility emerges precisely within this field of openness and uncertainty.
