An Examination of Extrajudicial Divorce (Talāq) in the US Law Courts

Abstract

This article deals with talāq as highlighted by some US court cases. Talāq, which is the repudiation of the wife by the husband, is classified as an extrajudicial divorce. The husband has the right to divorce his wife through three declarations of divorce (talaq). It can be used separately or pronounced at once. Talāq is also classified as revocable and irrevocable. If the husband pronounces it with clear words such as ‘I divorce you’, it is called revocable divorce (talāq al-rij‘i). If he pronounces it with an ambiguous word such as ‘leave home or go to your parents’ home’ with the intention of divorce or during the discussion of divorce, it is called irrevocable divorce (talāq al-bāin). US courts have different approaches to this type of divorce. While some US courts grant comity, others do not recognize it on the ground of different legal reasons. Some see it against the public policy of the State, whereas others refuse it on the ground of dissatisfaction of legal requirements of the State. If the marriage is solemnised in accordance with Islamic law and the husband receives a divorce decree in a law court of a Muslim country, this type of divorce should be accorded to comity irrespective of the satisfaction of legal requirements of the States. However, if the husband pronounces divorce outside of a court of law, the judicial authority of US should have the right to examine the divorce and the terms of the divorce. This study will investigate the concept of talāq in Islamic law and its application within the US law courts.
