People who become the agents of a judicial case for any reason apply to court interpreting as a subfield of community interpreting when they do not have the command of language of the trial. The translatorial act aiming to remove the language barrier in general contributes to fair trial and the protection human rights. Providing the right to a fair trial depends on the qualities of the interpreters that provide the service professionally and their management of the interpretation process. Court interpreters are assigned during hearings and legal proceedings in Turkey in order to remove the language barrier. Interpreter lists have been created to assign interpreters effectively in a short time. When the lists are examined, it has been determined that elements affecting the quality and functionality of interpretation process are included in the lists and the need for a standard for this purpose has been realized. Therefore, the National Occupational Standards for Translation that determines the criteria of a qualified translation service and handles the translation process with all of its aspects has been chosen as the corpus of this study. Criteria in the National Occupational Standards for Translation have been analyzed in terms of its applicability to court interpreting in light with functional theories that are regarded as process-oriented theories. As a result of this analysis, it has been revealed that some of the criteria in the National Occupational Standards for Translation are very good guides for court interpreting, but some are not feasible in terms of applicability, and the National Occupational Standards for Translation does not produce a solution for some issues. In addition, it has been understood that both the quality of the translator and the fact that actors involved in the translation process are conscious and open to cooperation on the relevant issues are important for the applicable criteria.

Toplum çevirmenliğinin bir alt alanı olarak ele alınan mahkeme çevirmenliği, herhangi bir nedenle adli bir vakanın parçası haline gelmiş olan kişilerin yargılama dilini konuşamadıklarında devreye girer. Genel olarak dil engelini kaldırmayı amaçlayan bu çeviri eylemi, adil yargılanmanın gerçekleşmesine ve insan haklarının gözetilmesine katkı sağlar. Adil yargılanmanın gerçekleşmesi ise profesyonel anlamda çeviri hizmeti sunan çevirmenlerin niteliklerine ve çeviri sürecini yönetmelerine bağlıdır. Türkiye’deki mahkemelerde ve adli süreçlerde dil engelinin aşılması için mahkeme çevirmenleri görevlendirilir. Görevlendirmenin kısa bir sürede ve etkin bir biçimde yapılabilmesi için tercüman listeleri oluşturulmuştur. Listeler incelendiğinde çevirinin niteliğini ve işlevselliğini etkileyecek unsurların yer aldığı saptanmış ve bu alana hizmet edebilecek bir standardın gerekliliği anlaşılmıştır. Bu nedenle kaliteli bir çeviri hizmeti sunulmasına yardımcı olan ve çeviri sürecini tüm yönleriyle ele alan Çevirmen Ulusal Meslek Standardı (ÇMS) bütünce olarak belirlenmiştir. Çevirmen Ulusal Meslek Standardı’nda yer alan ölçütler, çeviri sürecini öne çıkaran işlevsel kuramlar ışığında, mahkeme çevirmenliğinde uygulanabilirliği açısından incelenmiştir. Bu inceleme sonucunda ÇMS’de yer alan kimi ölçütlerin mahkeme çevirmenliğine çok iyi bir rehber oluşturduğu, fakat kimisinin uygulanabilirlik açısından çok elverişli olmadığı, kimi konularda da ÇMS’nin bir çözüm üretmediği ortaya çıkmıştır. Ayrıca uygulanabilir nitelikte olan ölçütler için çevirmenin niteliği kadar, çeviri sürecine dâhil olan aktörlerin ilgili hususlarda bilinçli ve iş birliğine açık olmalarının da önemli olduğu anlaşılmıştır.
