İspanya’da Kentsel Toplumsal Bir Hareket Olarak Okupa: ‘Mülkiyet’ ve ‘Konut Hakkı’nı Birlikte Düşünmek

Öz

Adını İspanyolca’daki ‘işgal et’ anlamına gelen ‘okupa’ sözcüğünden alan bu toplumsal hareket, bilhassa metruk yahut boş gayrimenkullerin, sahiplerinin rızası hilâfına ve türlü sebeplerle işgal edilmesinin bir sonucu olarak ortaya çıkmaktadır. Bu sebeplerin en başta geleni kuşkusuz barınma ihtiyacıdır. Ancak bunun yanında hareket, işgal ettiği bina veya konutları kendi sosyo-kültürel aktiviteleri için de kullanabilmektedir. Mazisi 1980’li yıllara kadar dayanan ve özellikle Madrid ve Barselona gibi kentlerde etkili olan bu hareketin mensupları genellikle evsizler ve genç aktivistlerdir. Mülkiyetin yasalarla güvence altına alındığı bir ülkede ayrıksı nitelikler sergileyen bu harekete karşı yakın zamana kadar etkili tedbirler alınamamıştır. Fakat son dönemde, işgal edilen mülklerin tahliyesini hızlandırma amacı güden veya işgalin türüne göre kimi müeyyideleri ağırlaştıran bir yasal düzenleme hayata geçirilebilmiştir. İşte bu çalışma ‘Okupa’ hareketini, onu ortaya çıkaran koşulları ve hareketin yasal düzenlemeler karşısındaki konumunu ilgili literatüre ve hukukî metinlere dayanarak analiz etmekte, ayrıca söz konusu hareketi mülkiyet ile konut hakkı arasındaki gerilim bağlamında tartışmaktadır. Bulgular, işgaller karşısında mülkiyet güvencesini artıran yasal tedbirlerin, yine Anayasa’nın teminat altına aldığı ‘konut hakkı’nı gerçekleştiren bir politikayla desteklenmemesi durumunda, olumlu sonuç vermesinin zor olduğunu göstermektedir.
