Bu çalışmada fıkıh usulünün temel kavramlarından biri olan neshin mahiyeti, imkan ve vukuu incelenmiştir. Neshe konu olan şeyin hüküm olması sebebiyle neshin fakih ve usulcüler açısından deliller arası ilişkileri düzenlemede önemli bir rolü bulunmaktadır. Bu yüzden nesih teorisinin çerçevesi esas itibariyle fakih ve usulcüler tarafından çizilmiştir. Bu sebeple de çalışmada temel fıkıh usulü eserleri referans alınarak usulcülerin bakış açısının ortaya konulmasına çalışılmıştır. Nesih usulcüler tarafından biri kaldırma (ref‘), diğeri açıklama (beyan) olmak üzere temelde iki şekilde tanımlanmış olup her iki tanıma göre de bedâyı gerektirmez. Neshin imkan ve vukuu usulcüler tarafından ittifakla kabul edilmiş olup bunun şeriatlar arasında veya aynı şeriat içerisinde olması arasında bir fark yoktur

THE TRUE NATURE OF THE NASKH IN THE METHODOLOGY OF CLASSICAL ISLAMIC LAW

Öz

In this article we have studied the true nature, possibility and occurrence of the naskh (abrogation) which is one of the basic concepts of the methodology of Islamic law. Since the subject of the abrogation is a legal ruling, from the perspective of jurists and methodologists it plays an important role in the arrangement of connections between proofs. Thus the framework of the theory of abrogation was essentially drawn by the jurists and methodologists. Therefore in this study we tried to present the view of the methodologists by referring to their main methodology works. Naskh was defined by methodologists basically in two forms: the first one being remowing, the second one being explanation and according to the both definitions it does not necessiate badâ’ (becoming evident). The methodologists unanimously accept the possibility and occurrence of the naskh no matter whether it be within a revealed law of a divine religion or between the revealed laws of divine religions
