ERKEN CUMHURİYET’İN EŞİĞİNDE İSTİKLÂL MAHKEMELERİ: AMASYA VE ELCEZİRE’DE GÜVENLİK ÖNCELİKLERİNİN KARAR DEFTERLERİ ÜZERİNDEN KARŞILAŞTIRMALI ANALİZİ
Öz
Bu çalışmada, İstiklâl Mahkemeleri’nin Millî Mücadele’den erken Cumhuriyet’e geçiş sürecinde (1920-1923) yalnız “istisnaî sertlik” veya merkezî niyetle açıklanamayacak ölçüde bölgesel farklılaşan işleyişi, karar defteri düzeyinde karşılaştırmalı biçimde incelenmektedir. Alan yazında mahkemelerin ya seferberlik koşullarının zorunlu bir uzantısı ya da rejim kurucu bir baskı aygıtı olarak ikileştirilmesi, hukukî çerçeve altında farklı mahkemelerin hangi suç evrenlerini öne çıkardığı, hangi yaptırım paketlerini standartlaştırdığı ve hangi meşruiyet dillerinin kurulduğu soruların ikincilleştirilmesiyle sonuçlanmıştır. Bu problemden hareketle çalışmanın amacı, merkezî normatif çerçeve sabitken iki bölgesel mahkemenin pratiklerinden türeyen “öncelik setleri” ve “uygulama mantıkları”nın, niyet atfetmeksizin, gözlenebilir göstergeler üzerinden yeniden inşa edilmesidir. Bu yaklaşım, Türkiye’nin erken Cumhuriyet tarih yazımı açısından önemlidir; zira olağanüstü yargının taşrada egemenlik kurma biçimlerine, güvenliğin hangi bileşenlerle tanımlandığı ve devlet kapasitesinin hangi alanlarda tahkim edildiğine dair tartışma zeminine katkıda bulunmaktadır. Yöntem olarak karşılaştırmalı-belge temelli bir durum analizi benimsenmiş; birim olarak “karar kaydı” seçilmiş; diplomatik okuma ile kayıt dilindeki formüller çözümlenmiş; suç etiketleri, yaptırım kategorileri ve gerekçelendirme kalıpları bir kod kitabıyla kodlanmıştır. Veri seti, Türkiye Büyük Millet Meclisi neşirlerinde yer alan üç cilt üzerinden kurulmuş; Elcezire İstiklâl Mahkemesi için 16 Mart–13 Mayıs 1923 dönemini kapsayan 90 karar özeti; Amasya İstiklâl Mahkemesi için 520 ve 521 esas numaralı karar defterleri (12/11/1920–18/10/1921; 521: 19/10/1921–09/01/1922) ile ilgili çerçeve (takdim) metinleri birlikte kullanılmıştır. Takdim metninde İstiklâl Mahkemesi’nin kuruluşu 27 Temmuz 1922 olarak verildiğinden, bu çalışmada “Amasya vakası” kronolojisi kuruluş tarihinden değil, 520–521 karar defterlerinin kapsadığı zaman penceresinden (12 Kasım 1920–9 Ocak 1922) hareketle operasyonelleştirilmiştir. Bulgular, Elcezire’de mandatın “askerî firar” ekseninde daraltıldığı; dosya akışının zaman eşiği ve aidiyet/iade formülleriyle filtrelendiği; portföyün firar çekirdeği ve firarı kolaylaştıran iştirak pratikleri ile rejimi zayıflatan rüşvet/suiistimal ve belge-ihbar ihlalleri çevresinde yoğunlaştığı şeklindedir. Amasya’da ise kuruluş bağlamının asayiş bozulması ve havza ölçekli güvenlik tehdidiyle kurulduğu; portföyün firarla birlikte silah-şiddet, örgütsel-siyasal dosyalar ve varidat/hazine ihlalleri yönünde genişlediği saptanmıştır. Suç türü sabitlenmiş karşılaştırmalarda Amasya’da “paket/standardize yaptırım”ın (özellikle değnek eşliğiyle) daha tekrarlı kurulduğu; Elcezire’de ise daha değişken ve koşullu bir yaptırım mimarisinin öne çıktığı görülmüştür. Gerekçelendirme dilinde Elcezire’nin daha teknik-inzibatî bir söylemle, Amasya’nın ise asayiş–devlet kapasitesi (“kuvâ-yı maddiye ve maneviyenin” rahnedarlığı) ve mali kapasite vurgusunu birleştiren daha yüksek yoğunluklu bir meşruiyet repertuarıyla çalıştığı belirlenmiştir. Bu bulgular taşrada devlet kapasitesinin “yargı” yoluyla inşa edilişini, yerel bağlamın kurumsal pratikleri biçimlendirdiği bir süreç olarak yeniden tartışmaya açmaktadır. Sonuç olarak, olağanüstü yargının aynı rejim altında dahi bölgesel tehdit ekolojileriyle etkileşerek farklı suç-ekosistemleri ürettiği; yerel güvenlik önceliklerinin portföy–yaptırım–gerekçe üçlüsü üzerinden ölçülebilir biçimde yeniden üretildiği; bu bulgunun erken Cumhuriyet’te taşra egemenliğinin tek çizgili değil, çok katmanlı icra edildiğini göstermeye katkı sunduğu ileri sürülmektedir. Bu, erken Cumhuriyet’in taşrada egemenliği tek bir çizgide dayatan yekpare bir merkezîlikten ziyade, farklı coğrafyalarda farklı “yönetim paketleri” kurarak çok katmanlı biçimde tahkim eden bir devletleşme pratiği izlediğini düşündürmektedir.

INDEPENDENCE TRIBUNALS ON THE THRESHOLD OF THE EARLY REPUBLIC: A COMPARATIVE DECISION-REGISTER ANALYSIS OF SECURITY PRIORITIES IN AMASYA AND ELCEZIRE
Öz
In this study, the regionally differentiated operation of the Independence Tribunals during in the transition from the National Struggle to the early Republic (1920–1923) an operation that cannot be adequately accounted for solely by “exceptional severity” or a unitary central intent—is examined comparatively at the level of decision registers. In the existing literature, the tribunals have often been framed through a binary of either a necessary extension of wartime mobilization or a regime-building apparatus of coercion, a tendency that has subordinated questions about which offense universes were foregrounded under the same legal framework, which sanction packages were standardized, and which languages of legitimation were constructed across different tribunals. Against this background, the aim has been to reconstruct, without attributing intent, the “priority sets” and “operational logics” emergent from the observable indicators produced by the practices of two regional tribunals while the central normative framework is held constant. This approach is significant for the historiography of early Republican Türkiye insofar as it contributes to debates on how sovereignty was constituted in the provinces, how “security” was defined through specific components, and in which domains state capacity was consolidated through extraordinary adjudication. Methodologically, a comparative, document-based case study has been adopted; the “decision record” has been selected as the unit of analysis; formulaic register language has been resolved through diplomatic reading; and offense labels, sanction categories, and justificatory patterns have been coded using a standardized codebook. The dataset has been constructed from three volumes published by the Grand National Assembly: for the Elcezire Independence Tribunal, 90 decision summaries covering 16 March–13 May 1923; and for the Amasya Independence Tribunal, the 520 and 521 principal decision registers (520: 12 November 1920–18 October 1921; 521: 19 October 1921–9 January 1922) used in conjunction with the relevant framing (introductory) texts. Although the editorial preface dates the establishment of the Amasya Tribunal to 27 July 1922, the empirical window for the “Amasya case” in this study is defined by the coverage of registers nos. 520–521 (12 Nov 1920–9 Jan 1922). The findings indicate that, in Elcezire, the mandate was narrowed around “military desertion,” the flow of files was filtered by temporal thresholds and jurisdictional return/competence formulae, and the portfolio concentrated on the desertion core and facilitative participation practices, alongside bribery/abuse of office and document–information violations that weakened the disciplinary regime; in Amasya, by contrast, the establishment context was structured around the deterioration of public order and a basin-scale security threat, and the portfolio expanded—together with desertion—toward armed violence, organizational-political files, and violations affecting revenue/treasury capacity. In offense-held-constant comparisons, a more recurrent “packaged/standardized sanctioning” logic (especially with the accompaniment of corporal punishment) was observed in Amasya, whereas a more variable and conditional sanction architecture was found to be salient in Elcezire. In justificatory language, Elcezire was characterized by a more technical and discipline-centered idiom, while Amasya operated with a higher-intensity repertoire that combined public order with state-capacity frames (including the notion of damage to the “material and moral power” of the state) and explicit fiscal-capacity emphases. These findings reopen discussion of the construction of provincial state capacity through “judicial” practice as a process in which local context shaped institutional repertoires, and they support the argument that, even under a single extraordinary legal regime, distinct offense-ecosystems were produced through interactions with regional threat ecologies, such that local security priorities were measurably reproduced through the portfolio–sanction–justification triad. In turn, this suggests that early Republican state-building in the provinces was consolidated not through a uniform, linear centralism, but through the establishment of differentiated “governance packages” tailored to distinct geographies.
