Abortion Crime at Turkish Penal Code

Bir tarafta insan türüne ait, ana rahminde gelişen ceninin yaşamı, diğer tarafta kadının gebeliğin devamını tercih etmesi arasında makul ve meşru sınırın çizilmesi, çözümü zor bir sorun görünümündedir. Kanaatimizce dünya genelinde ortak bir düzenleme imkânı mümkün görünmese de, her toplumun gelmiş olduğu seviye dikkate alınarak, bir hukuki düzenlemenin yapılması, en makul çözüm görünümündedir. Nitekim Türk Ceza Kanunumuz, tıbbi zorunluluk dışında her anne adayına tanınan on haftalık gebeliği sonlandırma süresini dikkate alarak bir suç tanımı düzenlemiştir.Kanun koyucu, bu suç tanımıyla öncelikle ana rahmine yerleşmiş ceninin yaşam hakkını korumayı amaçlamıştır. Bununla beraber, kadının vücut dokunulmazlığı, kendi kaderini tayin etme hakkı da korunmaktadır. Esasen burada ceninin yaşam hakkıyla kadının vücut bütünlüğü üzerinde tasarruf hakkının ve kendi geleceğini tayin hakkının çatışması söz konusudur.
