"Recipient Offender" From a Conceptual Perspective in Criminal Sentence Law

Abstract

In criminal law, the concept of “recipitant offender” refers to the situation where a person recommits a crime despite having a previous final conviction. Recidivism is not only an individual phenomenon reflecting the perpetrator's propensity to commit crimes, but also a structural indicator that questions the effectiveness of the criminal justice system in combating crime. Article 58 of the Turkish Penal Code regulates the special execution regime for repeat offenders and makes the conditions under which these individuals can benefit from conditional release more limited than for other convicts. However, there is no consensus in the doctrine regarding the legal nature of the institution of recidivism. While some authors consider recidivism a regulation specific to criminal law, others argue that it has a mixed structure linked to the substantive dimension of criminal law. Recidivism occupies a controversial position in criminal justice in terms of the balance between deterrence, personal rehabilitation, and social protection. Despite its aim to prevent repeat offending, it can lead to consequences that make it difficult to reintegrate the offender into society. This study examines the concept of repeat offending within the framework of the fundamental principles of criminal law, examining conceptual differences, practical consequences, and controversial aspects within the context of national legislation and doctrine.
